samenvatting: Thousands of lesbian, gay, bisexual, trans and intersex (LGBTI) asylum seekers apply for international protection in Europe each year. The European Union and European States have already taken some concrete and positive steps, such as recognising sexual orientation as a persecution ground in Article 10 of the Qualification Directive. Some Member States have also explicitly added gender identity as a persecution ground in their national legislation (Portugal, Spain) or policy documents (Austria, the United Kingdom). This report, however, shows that there are considerable differences in the way in which European States examine LGBTI asylum applications. As Europe aims at creating a Common European Asylum System with a uniform status, this is highly problematic. The Dublin system, according to which only one EU Member State examines an asylum application, presumes an illusory common standard in the application of refugee law which is sadly lacking. To counter these differences in asylum application treatment, the European Asylum Support Office should give priority to promoting and coordinating the identification and pooling of good practices regarding the examination of lesbian, gay, bisexual, trans and intersex asylum applications.

samenvatting: Tekst van een seminar gehouden op 8 mei 2015 in de Universiteit van Uppsala door Thomas Spijkerboek van VU Amsterdam over het issue gender- en seksualiteitdiscriminatie bij het toewijzen van asielaanvragen. Hij bespreekt daarbij onder andere een voorbeeld van een zaak waarbij de European Court of Human Rights heeft geoordeeld dat een asielaanvraag mag worden afgewezen omdat de lhbt-persoon in kwestie een normaal leven kan leiden in het land van herkomst mits hij/zij zich maar discreet gedraagt.

samenvatting: In de afgelopen jaren is de positie van LHBT-vluchtelingen verbeterd, omdat een aantal kwestieuze praktijken om hun asielverzoeken af te wijzen is afgeschaft. Toch blijft er spanning bestaan tussen de restrictieve manier waarop mensenrechten worden geïnterpreteerd in de context van asiel, en de ruimere interpretatie daarbuiten. Zo beslissen ambtenaren over de gender- en seksuele identiteit van asielzoekers, en wordt strafbaarstelling van homoseksuele handelingen in het land van herkomst niet als vervolging in de zin van de vluchtelingendefinitie aangemerkt.

samenvatting: The feminist critique of refugee law was first formulated in the early 1980s. It concerned the public/private distinction (disregard for sexual violence, for women?s contributions to political opposition), and the neglect of gender as a persecution ground. Sexual violence as a form of persecution and gender as a persecution ground were incorporated in Western refugee law in the wake of the Bosnian refugee influx, via UNHCR and EU law. In the early 1990s the first arguments for asylum for lesbians and gays were made. Here, main issues were recognition of the multi-faceted predicament of LGBT (Lesbian, Gay, Bisexual and Trans) people as persecution; recognition of sexual orientation as a persecution ground; discretion (i.e. do it yourself-protection by giving up the right you want to exercise - I will get back to that); and credibility. In this contribution, I want to take stock of what the gender and sexuality based critiques of refugee law have achieved. As this is an over-ambitious aim for a 35-minute talk, this will reflect a very partial perspective. I will not be able to do justice to the vast and very valuable body of literature on these topics. I will first address statistical issues, because it makes sense to start with the question whether female or LGBT asylum seekers get asylum less often than straight men. Then I will address the question how law is being applied today, now the gender and sexuality critiques of refugee law have been incorporated in legal practice. Having done that, I will try to understand this reformulated refugee law by using the concept of sexual nationalism.
