resume: Niet de bezetting, maar de bevrijding betekent een omwenteling in de antihomoseksuele strafvervolging, dat is de centrale stelling in het proefschrift van Anna Tijsseling dat op 23 december 2009 is verschenen. Ondanks het gebrek aan wetenschappelijk onderzoek, ontstond vanaf de jaren zeventig een dominant beeld van de bezettingstijd als een uiterst repressieve periode voor homoseksuelen. De beschikbare gegevens wijzen op een tegengestelde trend. Zo weerspiegelen de Nederlandse criminele statistieken juist een stagnatie in het aantal strafzaken tegen verdachten van homoseksuele zedenzaken tijdens de jaren van bezetting. Schuldige seks gebruikt deze intrigerende discrepantie tussen het ontstane beeld over de homovervolging en de beschikbare gegevens als een punt van vertrek. Anna Tijsseling beantwoordt de vraag in hoeverre het antihomoseksuele beleid van de Duitse bezetter voet aan de grond kreeg in de dagelijkse politiële en justitiële werkpraktijk in het Haagse arrondissement. Op basis van niet eerder gebruikt materiaal uit het Haagse rechtbankarchief laat zij zien dat de Duitse machthebber geen vat kreeg op de ingeburgerde gedachten over homoseksualiteit tijdens de bezettingstijd. Terwijl de Duitse bezetter alle betrokken mannen bij homoseksuele contacten wilde vervolgen (Verordening 81/1940), werden in de Haagse praktijk - net als vóór de oorlog - vooral de oudere mannen vervolgd (artikel 248 bis Wetboek van Strafrecht). Het Haagse denken over homoseksualiteit als een aandoening waarbij oudere mannen jonge mannen op het verkeerde spoor zetten, veranderde niet onder invloed van de Duitse antihomoseksuele verordening. Pas na de bevrijding blijkt er sprake van een opmerkelijke omslag in deze rechtspraktijk. Vanaf dat moment laat een deel van de verdachten van homoseksuele zedendelicten een opmerkelijk eigenzinnig geluid horen. Tijdens het hoogtij van de strafvervolging van verdachten van homoseksuele zedendelicten, waarbij 1949 een historisch hoogtepunt vormt, wordt gelijkberechtiging geëist. Dat is nieuw in de rechtszaal! Schuldige seks laat zien dat met name de naoorlogse tijd een interessante periode is voor collectieve herinneringen waar het de antihomoseksuele strafvervolging betreft. Het is een paradoxale periode van intensievere strafvervolging en tegelijkertijd van een zelfbewustere manier van spreken.

resume: This paper investigates the ways in which notions of femininity and masculinity informed the interpretation of sex as sexual transgressions in the perception of professional agents involved in the prosecutions of sex crimes. The analysis is based on a collection of data on sex crimes retrieved from the district court of The Hague in the Netherlands between 1911 and 1957. Before turning to the practice of investigating and prosecuting sex crimes in the Dutch court district mentioned, we need to explore two themes. First, the dramatic paradigmatic shift changing the practice of prosecuting (sex) crime in the first half of the twentieth century needs to be addressed. Secondly, we need to understand the strictly legal sexual prohibitions. After all, since the Enlightenment, the legal history of sexuality has revolved around three basic themes throughout the Western world. Age, consent and compensation have moulded the borders between appropriate and inappropriate sexual behaviour. Still, these basics have been worked out quite differently in varying Penal Codes (hereafter PC) across time and place.
